Terms & Conditions.

These Terms & Conditions apply to everyone who visits or uses the FOAMY WHITES website at foamywhites.com (the "Site") and to anyone who places an order through our shop. They set out the basis on which we make our products available and the rights and responsibilities of both you and FOAMY WHITES ApS ("FOAMY WHITES", "we", "us" or "our").

Please read these terms carefully before placing an order. If you do not agree with any part of these terms, you should not use the Site or place an order.

The Site is provided so you can learn about FOAMY WHITES, browse our cocktail library, and purchase our products. You may use the Site only for lawful purposes and in a way that does not damage, disable, overburden or impair it.

We do our best to keep product information, pricing and availability accurate, but we cannot guarantee that every detail on the Site is error-free. We reserve the right to correct errors and to update the Site at any time.

FOAMY WHITES is a pasteurised liquid egg white developed for cocktails, bars and home mixology. Ingredient, allergen and best-before information is printed on every bottle and summarised on the product page.

Product descriptions, images and specifications are for guidance only. Minor variations in packaging or appearance do not affect the quality or suitability of the product.

Prices shown on the Site are in Euros and are displayed excluding VAT by default. An indicative price including VAT may also be shown for consumers. Final VAT is calculated at checkout based on the destination country and the details you provide.

EU businesses with a valid VAT number may be invoiced under the reverse-charge mechanism. Prices and availability may change without notice.

When you place an order, you will receive an order confirmation by email. This confirms that we have received your order; it does not mean the order has been accepted. A binding contract is formed only when we confirm acceptance and dispatch the goods.

We reserve the right to refuse or cancel an order at any time, for example in the event of a pricing error, stock unavailability, suspected fraud or inability to verify payment details. If we cancel an order after payment has been taken, we will refund the full amount.

Orders are processed through Shopify checkout. Payment is required in full before goods are dispatched. We accept the payment methods shown at checkout.

All payment information is handled securely by our payment processors. We do not store your full payment card details.

We currently ship throughout the European Union. Available shipping options and estimated delivery information are presented during checkout based on your delivery address.

Delivery times are estimates only and begin from the date of dispatch, not the date the order is placed. FOAMY WHITES is shelf-stable and does not require cold-chain shipping.

Risk in the goods passes to you once the order has been delivered to the address provided at checkout.

As a food product, FOAMY WHITES is exempt from the standard EU right of withdrawal once the seal has been broken, in accordance with applicable consumer legislation. Sealed, unopened bottles may be returned within 14 days of delivery, provided they are in their original condition.

To start a return, contact us at sales@foamywhites.com with your order details. Return shipping costs are your responsibility unless the return is due to our error or a defective product. Refunds are issued to the original payment method once the returned items are received and inspected.

If your order arrives damaged, defective or incorrect, please contact us as soon as reasonably possible after delivery with your order number and, where possible, a photo. We will review the issue and, at our discretion, arrange a replacement or refund for the affected items.

In cases where we are responsible for the damage or error, we will also cover any reasonable return shipping costs.

The FOAMY WHITES name, logo, packaging, photography, recipes, website content and other materials are owned by FOAMY WHITES or licensed to us. They are protected by copyright, trade mark and other intellectual property laws.

You may view and print pages from the Site for personal use. You may not reproduce, modify, distribute or exploit any of our content for commercial purposes without our prior written permission.

FOAMY WHITES is liable for direct damages caused by defective products in accordance with mandatory EU consumer and product-liability law.

To the extent permitted by law, we are not liable for indirect or consequential losses, loss of profit, loss of goodwill, or any loss arising from events outside our reasonable control. Nothing in these terms limits any liability that cannot be limited under applicable law.

These terms are governed by the laws of Denmark. Any dispute that cannot be resolved amicably will be brought before the competent Danish courts, without prejudice to any mandatory consumer rights available in your country of residence.
